A 67-year-old woman walking down a New Jersey street glanced down at her phone only a moment before she plunged down a sidewalk opening and into a cellar.

The woman’s son, who was not named, told CBS2 he was grateful his mother survived the fall, but emphasized that it wasn’t just the distraction of her cellphone that caused the spill. She’s legally blind and diabetic and was checking the time because she was feeling a bit nauseous, he said.

So, do you think that she has grounds for a lawsuit?

So she has enough of her sight to be able see the time on cell screen that inches high and wide...

But not enough sight to see a roughly 3' x 6' piece of steel blocking the sidewalk directly in front of her?

Sure she could sue but she wouldn't have much of a chance on winning if i was on the jury though.

The color of the doors do seem to match the sidewalk. Perhaps she thought it was 3D sidewalk art...

It's interesting the two women walking by seem to be afraid to look to see if shes OK.

If... I was her lawyer and you were the defense lawyer, I'd retort that due to her disabilities she is no longer able to drive a car. The workman should have set up cone or caution tape barriers. A sympathetic jury would, I think, agree with me.

No...
I could see a lawyer trying to put all the fault on the store/property owner for having the doors to the sub-basement open in the first place.

And i'd probably have no chance at getting in/on a jury in a case like this.
