This is not uncommon in legal terms. Legislatures often leave patently un-contitutional stautes on the book even after a court has struck them down, as some sort of posturing that Marbury v Madison was wrongly decided.

It became a fashionable way for state legislatures to tacity deny the power of the courts, especially after the civil rights act of 64, when many southern states refused to repeal segregation and anti-miscegnation laws.

It does actually do some harm . I've seen a mistrial declared in a criminal case becaue the sentencing staute cited by the prosecution hade been declared unconstitution by the Oklahoma Supreme Court ten years earlier, but the legislature had left it on the books.

Every time someone gets caught in a crime that somehow unmarried sex was related, they get to charge them with Fornication and another $250 fine..

just as an example...

How many time a year to you think tickets are written for two people having sex in a car... if they are not married.. whcih most people having sex in a car probably are not.. on top of whatever else gets thrown at them, they also get the old standby... Fornication...

Only time I ever saw anybody enforce that one was when a PO violated a parolee for returning to this chick he was shooting dope with. He was a stickup guy, out doing armed robberies to be able to buy their speedballs, and that's what he was convicted for.

When he got back with his favorite chicka, that was it-- they violated him for violating state statute 798, as there was a sudden rash of armed robberies near where they set up their latest shooting gallery.

He swore it wasn't him. But it didn't matter... they didn't violate him for armed robbery, they violated him for "living in a state of open adultery".

Also worthy of note: the armed robberies in his neighborhood stopped right when they stuck him back in FSP.

JJ, no, I enjoy the "out of bed" look. My dad beat my butt for combing my hair with middle part,it was worth it. Men should not groom like women, be strong and talk ULTRA BS NEVER fails.
