Why the hate Dave? I figured I would wake up to at least 10-15 pages of anti-Dean rhetoric. Looking for a bit of consistency, but alas, it has barely gotten off the ground.The hypocrisy runs thick. Perhaps you have something of substance to contribute Davey other than ill will?


What Gibson have done here is actually very, very serious.

Especially if they lose the trademark suit in the US.

They have threatened guitar stores to stop stocking Dean with absolutely no legal grounds to do so at that point in time.

That is seriously wrong.


How do you know Gibson had no legal grounds. How do you know that? The answer is you don't. You have no idea what Gibson's contracts state relative to being a dealer.

Perhaps Gibson had no compete clauses in dealerships awarded and Gibson interpreted it to mean guitars that could be mistaken for Gibson's by the average shmo. I don't know, and neither do you, or anyone else here.

Whether it was sensible to go after dealers is another story.

The interference with contract isn’t the conduct that makes it illegal. It’s the “tortious” part.

Gibson cannot commit this tort if it has the legal right to interfere.

And if the retailers did not stop selling Dean guitars, there is no damage anyway.

Great headline grabber but in real life very little prospect of Dean being on a winner, amd even so, what’s its damage? In civil litigation you can certainly get punitive damages, but you cannot get punitive penalties if no damage has been suffered. Penalties are generally statutory, not tortious.

Yes, but Gibson went a step further by stating that even stocking Dean guitars is an infringement (not possible) and retailers were contacting Armadillo concerned about stocking any more guitars from them.

That is what makes it a serious matter.

What else would you call what Gibson did.......?

Since the guitar stores had the legal right to sell those guitars at that time.

Gibson tried to use their power over a guitar seller.

What else is it.

In the world of business its probably just part of doing business
