    pointing out that kayaking in a humpback whales nautral inshore habitat
    and getting so close to them as in the photo and then the stated purpose in the article is for eco tourism should be criminal, which I believe it is under National Marine Mammals protection laws

    A little further up the coast from Santa Cruz, where the Great White Sharks hangout, we call those kayaks "surface lures."

    Some guy had the back end of his kayak bitten off a few years ago by a Great White (made to the beach in record time too)!

    I have gone kayaking out there, its amazing. Last time I was out there, I looked down... and there was a huge shark laying at the bottom.

    I used to kayak tons in rivers and ponds, never the ocean though. That's pretty cool.

    I don't see anyone getting hurt by this. Whales look like they are having fun, the guy had an amazing experience getting close to nature. Its all good.

    not according to the scientists and fisheries veterinarians who consulted the marine mammal protection act and the law which requires you to remain 300 ft from surfacing and subsurface marine mammals

    these humpback whales are in these shallow waters for a purpose and they are displaying courting

    How is a guy in a kayak supposed to know whats going on 150 underneath him?? There are Kayak rentals right there at Cannery Row in Monterey, I have rented there before. And, its right near the Coast Guard base. I am going to go out a limb... and say its legal.

    I was there shooting pictures of the same group of whale from the shore shown on the background. My image is not this close but shows the whales with the kayaker and the boat where this photographer took his shot.

    It was a surfing competition event and a movie production was also participating for an upcoming 2012 surfing movie.

    the news says is was a planned shoot...that far out for surfing ?

    and the kayaker said he specifcally targeted these lunge feeding endangered species for pleasure..... an act which as described by the news and pointed out by ishmaelboner...... is illegal

    but we will promote it for $$$$$

    Heres what i saw. The boat and the kayaker was there before the whales. the photographer was presumably taking promotional shots of the surfing event and everything interesting. When the whales showed up and got closer to shore then the kayaker and the boat just stuck around them. They did not go out of their way to get close but just got lucky enough to be close by. There were other boats and kayakers but farther away from the whales.
