For me the only thing that would make it right to sell it in this manner(nevermind legalities) is to permanently mark the back of the head stock, carve it in, stamp it, something to identify as FAKE. Cause you know if it is not permanently marked, a shrewd someone will buy it cheap and then try to make a quick profit selling it again under false pretenses and unless your still a little wet behind the ears, one must surely have considered that scenario, especially if the current seller had been a victim-buyer themselves. Current seller trying to recover some of there loss at the expense of a future victim- buyer.

For used guitar purchases on ebay the only safe bet in the future will be buying b-stock where only legit guitars are currently stamped USED.

Because ebay sucks so does paypal.

I found with a little patience I can sell or buy on craigslist, save the paypal and ebay commission and be better off. I also get to see the instrument I want to buy, actually hold it and play it before I buy it.

Or I could buy off ebay, see a picture of a real Les Paul, pay for it, have the guy send me the worst fake, actually molded out of plastic. Ebay and paypal do nothing. I have found the convenience factor isn't worth the risk. One mistake and you regret it.

It can still be reported. It's against their rules to sell counterfeit items, regardless of disclosure.
