Nevertheless, there are still avenues he can take before resorting to legal action which will save him headaches (not to mention attorneys' fees). In fact, doing so without going through the ebay system first could hurt a claim.

I'm not trying to be insensitive to his plight, more trying to put some perspective on it. In no way am I endorsing the actions of the seller.

Get a lawyer. Sue for damages. It won't put this guy away, but with the evidence you have plus a decent lawyer, you'll get your money back and more.

What happened was a money transfer. No way of getting back. It acts like cash. Once you give it, it's gone. Now, put yourself in JimmyAce's shoes... Being a moron in this situation is sitting on a chair, waiting for someone to take action, and HOPE that everything turns out fine. That someone won't take action because the $15,000 wasn't his anyway.

It looks like at this point there's no guitar to ever be shipped and the guy has basically admitted there's nothing there. I agree he should report it to e-bay, but since there was a wire transfer I don't know how they can help on the money side.

I'm usually slow to advise getting a lawyer (I am one), but here I'd start shopping for one in the jurisdiction where this dude lives. It'd be ideal to find one who does civil practice, but who also knows the DA and local law enforcement.

I haven't said a lawyer is out of the question either. I don't appreciate it also, Vast, that you think I think he should just sit tight with his thumb up his ass. I didn't say that.

The FIRST step he needs to do is contact ebay. A $15,000 purchase is pretty big even by ebay standards and he, as a buyer and ebay account holder has rights. Then, if ebay refuses to get involved over some nitpicky issue ("oh wire transfers aren't covered") etc, he should hire legal assistance ASAP.

In that event both Ebay as well as the seller should be taken to task.

Sorry buddy, I didn't mean to hit on you. The message was for everyone, and I just used your post as a reference. Sorry about it bro for the misunderstanding. If my post seemed like I was putting words into what you've said, sorry if it turned out that way. I did not intentionally mean that. I just didn't like the "moron" word.

It's okay man, No harm, no foul.

I sincerely hope Jimmy gets his satisfaction. It's upsetting that people take advantage of other people thus.

Ebay too, to an extent, is at fault. They're very lassiez-faire when it comes to their approach to dispute mediation and taking action. Almost all their actuons are a slap on the wrist.

Well hell let's don't get mad at each other; none of us are the con artists. We all just want Jimmy's situation to be made right. The report to e-bay is certainly the right thing to do first. It's up to them to say what they'll do, and hopefully they'll do something, I'm just not sure what it is they can do - but that's for them to say.

Anyhow, I find this funny (or sad, pick one):

In order to even have a PHONE NUMBER to talk directly to ebay, you need to be a certain rated power seller. It's ridiculous. It's stuff like that, and Jimmy's case, that I refuse to do business on ebay for anything more than 4-500 dollars.

Yes, I filed with ebay yesterday. Also, I got them in the loop a week ago. They are worthless. Period. No help whatsoever. What we are dealing with here is a total scam, theft, fraud. And it is much larger than me. It is on a huge scale - not just one guitar on ebay. It is international organized crime, rampant throughout ebay, craigslist, etc. If this had to do with a lazy seller who changed his mind or just didn't have any desire to follow through with the deal, that would be one thing. But this group never even had the guitar in the first place.

No chance. The guy who's name they used for the fronting of this flim flam was handling $ transactions under the assumption that they were for interior design consulting fees, not ebay sales or anything to do with guitars. He sent the money to two individuals in Russia. Organized crime.

They don't even know who to sue. The culprits are foreigners. They duped an unemployed American into taking a job as an account manager under the guise that he was starting his own business. It helped cover their tracks since they were able to trick an American into sending the money for them.

My .02.
Taking action against the American who was hired to manage the account will not get me anywhere. He quit the job as soon as he learned it was fraud. So he is unemployed again, with no resources. No money to get from him. Unless his homeowners insurance covers identity theft. His identity was stolen by these people who were supposedly getting him started in his own business. They acted on his behalf without his knowledge and pretended to be him on ebay, emails, and on the phone.

I'm very sorry for you man. I wasn't aware of that detail of the situation. I agree with the ebay = worthless part.

So it seems that you won't be able to take any action against the seller/scammers themselves. In this case I suggest taking action directly against ebay for letting it happen. Either they start making a marketplace they're willing to their guarantee on as well as seal of approval (their money where their moth is) or they shouldn't be in business at all. This is ludicrous.
