JimmyAce, man sorry to hear what you are going through, I'd get the advice of a good attorney, Its so hard to keep positive and calm with so much cash on the line, but I think the chances are good that with 500 positives this situation will be resolved, what else is ebay saying?

Well I will go against the grain here and say slam this guy hard! You won the auction nearly 2 weeks ago, the fact he has your money and you have nothing but headaches for 15k is absurd.

Give him a scathing eBay remark, list the item and dollar amount, that would be where I would start. First thing, his problems he is going through is exactly that, his problems. 12 days is more than enough time to get his Sh** together and ship your guitar. The fact he has not done so is absolutely unacceptable.

Maybe send him one last email and let him know this is your final attempt at being patient, and its time to produce your item, if not, the follow communications will go to eBay, his feedback, then to his place of work, his banking institution, local law enforcement and your retention of an attorney.

Screw him, time to S* or get off the pot.

I hope it works out for you.

Good luck man, keep us posted. I hate ripp-offs.. Thats why I use pay-pal. I just went through this and with pay-pal you have up to 45 days to get you'r money back 100% for sure. I hope you get this resolved...... Also, I wouldn't leave a negative feedback yet, use that against him becuz he dosent want a bad one if he has 500 positives 100%....

If you get a chance to talk to him...Tell him his divorce is going to be the least of his worries...Then ask him about picking it up... If he has a problem with that then you know that something is not good.

I'm all for giving people the "benefit of the doubt" but sometimes it can go a little too far. If people are going to sell stuff on ebay...especially for large sums of money, they need to understand that they have a responsibility to get that stuff out ASAP...no excuses.

I have had MANY ebay exchanges where the seller all of a sudden has an emergency...I have had MANY deaths in the family...I know it can and does happen...but it seems that as soon as I win an ebay auction someone in the sellers family dies

Maybe it's me...I'm just cursed.

No, seriously.

Wouldn't legal action be too costly? Taking this shit to the courthouse, legal fees etc.

Maybe just visiting him (in a friendly way) would sort this out, as he just have to hand you the guitar that way.

Him going through a divorce and spending alot of time sorting things out is, to be honest, not your problem. When you put out an auction online, you have to make sure you can handle the deal properly without any problems. Unreliable sellers like that pisses me off!

I was bidding on an acoustic guitar, on QXL Auksjon kjøp og salg av brukt og nytt, for my girlfriend, so that I could teach her how to play guitar.

I won the auction and payed up through bank transfer. That's when all the excuses starting popping up in my inbox. "Oh, no. I broke my ankle. I'll have to ship the guitar when I get better".
The next day he was hard labouring at work and didn't have the time.
Yeah. That's likely for a guy who just busted his ankle.

To make a long story short, the police sorted everything out and I got my money back.

So I think it's not your bad luck. Maybe it happens to a lot of buyers out there.

Money Gram, Wire Transfer are things I avoid when dealing with online transactions.
They can be abused by scammers as their tools.

I wonder why you didn't use Paypal in the first place, but anyway since it happened already.

Paypal has limits which are pretty low for this item and they take a huge percentage. Plus read the horror stories at paypalsucks.com.
Better to avoid the internet and buy local or maybe through good forum folks. Screw ebay.

This is getting beat into the ground but my experience:

I bought a bassman head a few years ago. Paypal'd the money the guy transfers it to his bank and says he'll ship. I wait two weeks then contact. No response for another week. I contacted paypal. They wouldn't issue me a refund because he had withdrawn the money already, they said sorry you can file a claim with ebay and they will tell you the same. So I called my bank. Customer service looked up the states FBI internet fraud location called them and conferenced me in. Agent told me this was a minor issue but he would make a quick call. 3 days later I had my amp and my bank threatened paypal so I ended up with a 75% refund too.

I would not leave negative feedback until the issue is resolved b/c if anything that is a tiny piece of leverage and if you use it early that is one more reason for him not to resolve this. I would call and politely give him an ultimatum and a timeframe that you will follow before contacting the police and FBI. I would leave a VM and email, CC ebay resolutions center and a bank rep in the email so that there is record. If you don't hear back or he doesn't comply then move forward and send him a email with each step. He'll move on some sort of action if you take logical steps and keep it civil in the communication. If it comes to a legal battle you will need the email records that you send him.

15K should warrant a federal case if I'm not mistaken and why is your bank not doing more? Mine was for $600 and my bank was all over it and all over paypal.

You're right, I guess they would cover up to $2,000.
But I wouldn't buy anything through Ebay if it were more than what they can cover.

My money is gone. I was able to get his real number from someone. He was duped like me. Here is how it went down. He is unemployed. He went onto Career Builders online & found someone who wanted him to start his own business & make money. Before taking their employment, he checked them out with the Better Business Bureau in their home state. They had a perfect record for 5 years. So he went to work for them. Let's assume his name is John Doe. This company sets up a business called John Doe Online Services. And they set up a bank account in the name of his company. They send transactions to his bank account. He does not know where they come from. All he sees is a name and an amount. He takes the money out of the account and sends a money gram or Western Union payment to an individual in another country. He was familiar with my name and the amount I paid. He said he tried to find me but he had a bogus phone number for me. He sent the money to Russia. So when I called today, he was surprised to find out his employer has used his name on an ebay account and set up several bogus phone numbers in his name (identity theft), and fraudulently sold items using his name. Who knows if they are on Craigslist, ebay, etc. ? I am still owndering how they got 459 feedback score, 100% positive. Maybe they pruchased the ebay store from the original owner? Maybe they have been legit until now? The money is gone, no way to get it back. But this guy has been in contact with the local FBI & Fed Trade Commiss & Attorney General, has been calling me & giving me info on his contact at the company, etc. He seems pretty stressed out that he's possibly in trouble. I contacted my bank & asked them if they can get involved from the fraud stand point & who I might need to get involved as well. I wonder if my homeowners policy or maybe his policy would cover identity theft; some do. I plan to post the link to the auction at some point, but not yet.

Maybe they have been legit until now? The money is gone, no way to get it back. But this guy has been in contact with the local FBI & Fed Trade Commiss & Attorney General, has been calling me & giving me info on his contact at the company, etc. He seems pretty stressed out that he's possibly in trouble. I contacted my bank & asked them if they can get involved from the fraud stand point & who I might need to get involved as well. I wonder if my homeowners policy or maybe his policy would cover identity theft; some do. I plan to post the link to the auction at some point, but not yet.

Not sure I follow this .... He get's a bank account from some online company. Money starts flowing in. For what? He pulls out the money and sends it to Russia (for Gods sake!?!?). And he's not in on it? What is he? A complete idiot?

JimmyAce, so sad to hear! I'd be furious. I think people need to think twice before they start scamming others. Take me for instance. The kindest guy you'd ever meet. But besides my two lovely Les Paul:s, I also have these at home (and you never know what stupid things one can do when angry).
