This is a great story - each paragraph reveals epic failure on top of epic failure!

on a hate crime charge for allegedly beating a gay man at the Forest Hills T
station in an unusual case that experts say exposes the law’s flawed logic.

“My guess is that no sane jury would convict them under those
circumstances, but what this really demonstrates is the idiocy of the hate-
crime legislation,” said civil liberties lawyer Harvey Silverglate. “If you beat
someone up, you’re guilty of assault and battery of a human being. Period.
The idea of trying to break down human beings into categories is doomed to failure.”

Prosecutors and the ACLU of Massachusetts said no matter the defendants’
sexual orientation, they can still face the crime of assault and battery with
intent to intimidate, which carries up to a 10-year prison sentence, by using
hateful language.

“Someone who is Jewish can be anti-Semitic,” said ACLU staff attorney Sarah
Wunsch. “The mere fact that someone is a member of the same class doesn’t
mean they could not be motivated by hatred for their very own group.”

But Carolyn Euell, 38, mother of two of the defendants, Erika Stroud, 21, of
Dorchester and Felicia Stroud, 18, West Roxbury, told reporters the alleged
attack “can’t be hateful” because both her daughters are lesbians.

Prosecutor Lindsey Weinstein said the two sisters and one of their domestic
partners, Lydia Sanford, also a defendant, viciously beat the man Sunday,
repeatedly punching and kicking him after he bumped them with his backpack
on a stairwell.

She said the victim, who suffered a broken nose, told cops he believed the
attack was “motivated as a crime because of his sexual orientation” since
the three women “called him insulting homophobic slurs.”

But attorney Helene Tomlinson, who represented Sanford, told the judge her
client is “openly identified as a lesbian ... so any homophobic (conduct) is
unwarranted.” She said the alleged victim was the aggressor and used racial
slurs: “He provoked them.”

Felicia Stroud’s attorney, C. Harold Krasnow, said, “They don’t know what his
sexual orientation is, just like he doesn’t know what theirs is.”

Krasnow later noted the low bail the judge gave the women, $100 to $500
cash, and suggested the prosecution’s case was weak.

Civil-rights attorney Chester Darling agreed. “No one should go to court. It’s
knuckle justice,” he said. “It’s a fair exchange.”

But Jake Wark, a spokesman for Suffolk District Attorney Daniel F. Conley,
said prosecutors will have no problem proving the women committed a hate
crime, even if they are lesbians.

“The defendants’ particular orientation or alleged orientations have no
bearing on our ability to prosecute for allegedly targeting a person who they
believe to be different from them,” he said.

A couple weeks ago a bunch of nooses were found around a college here and a list with a black student names on them. The cops said the person responsible will be charged with a hate crime. They looked over the list and only one last name was spelled right. I turned out to be a black girl who did all this and she put her name on the list too but was caught because her name was the only one spelled right.. she confessed but I doubt she was ever charged with a hate crime.

Like Ron Paul says, there are human rights. There should not be black rights, gay rights, etc. They should not have rights designated to certain groups. Or rights described as for certain groups. It is simply human civil rights that we either all have or we don't.

And as other conservative candidates say, these rights we are born with. A government does not have the authority to grant or deny them, but the responsibility to protect them.

If we had more of those types of people, we wouldn't have had laws that:
- Enforced segragation
- Didn't allow women to vote
- Prevent gay people from marrying

A lot of the laws you are referring to are put in place to try to undo the existing "special custom made laws" that deny any chance for equal treatment under the law. All of the laws that enforced or allowed for unequal treatment were passed by "honest caucasoids who looks like an ordinary joe").

Nobody is "asking for equality". We already have that. People are asking for "equal treatment under the law".

Laws protecting equality are qualitatively different from hate crimes law.

As detestable as bigotry is, laws imposing harsher sentences for crimes driven by bigotry are silly. They are, in essence, the state meting out harsher punishment for thoughts.

They do that all the time, in ways you probably agree with.

Premeditated murder is punshished differently than DWI manslaughter, and differently still, than manslaughter due to other negligence.

In each acse, a person is dead due to the actions of others. The charged crime and sentence will vary with what the authoities believe the commiter was THINKING, prior to the death of the other.

With very little work, you can come up with dozens of examples of people being punished differntly based on thought (intent).

Again, I disagree with the wording of "hate crime" laws, and the way they are impossible to enforce in any sort of fashion that allows for equity under the law.

Yes, but in that case, the thought is itself planning out the illegal act. As such it can be construed as part of the act.

There's a difference in balefulness between planning a murder and hating a certain group. The first is necessarily a part of the crime. The second doesn't lead to the crime in the vast majority of cases.

This gets to the nub of the problem. What these laws are is a way for politicians to grandstand as being "tough on crime" while adding yet another law which really does very little to change anything, aside from stoke a victim complex and sense of self-righteousness in the bigots it seeks to penalize. It punishes the bigot for being stupid without having the requirement of showing that his stupidity was a vital component of the crime.
