Maybe if you find one of the cases mentioned, and give it to the DA, they might consider the applicability.
I think that a court applying the standards of reasonableness might well conclude he was intentionally sticking his head in the sand and not caring if something illegal was a foot, caring more about making a buck for himself.
I'm guessing you're not seeking to punish him but, rather, acquire a means to get the guy to repay you and to come up with the money in the event he is really able or ever able. |
